A federal judge in New Hampshire has put a stop to President Donald Trump’s executive order aimed at ending birthright citizenship for certain individuals in the United States, as a class action lawsuit progresses through the legal system.
This lawsuit, filed by the American Civil Liberties Union on behalf of immigrant families, seeks to challenge the Constitutionally guaranteed citizenship of infants born in the U.S. The judge’s ruling came on the heels of a Supreme Court decision that limited how universal injunctions can be issued by federal courts, yet still allows for legal actions to continue under specific circumstances.
The White House responded critically to the judge’s decision, asserting it undermines the Supreme Court’s authority. Spokesman Harrison Fields labeled the ruling as “an obvious and unlawful attempt” to sidestep the high court’s directive, vowing that the administration would vigorously contest what it claims are efforts by district judges to obstruct Trump’s immigration policies.
Trump’s push to revoke citizenship rights for the children of undocumented immigrants and foreign visitors has been a longstanding aspect of his administration’s hardline stance on immigration. The judge’s ruling prevents the executive order from being enacted temporarily while allowing the lawsuit to move forward on behalf of the impacted infants.
Following the Supreme Court’s earlier ruling, which upheld broader judicial limits without addressing the specifics of Trump’s birthright citizenship order, the administration faces a seven-day window to appeal this latest decision.
