
A federal magistrate has recommended that the legal proceedings against Milwaukee County Judge Hannah Dugan, accused of assisting an illegal immigrant in evading ICE arrest, continue. The allegations claim Dugan directed the individual to exit the courtroom via a private door, evading lawful authorities, after informing them that a warrant was required for arrest.
In a motion filed in May, Dugan argued for the dismissal of charges, asserting she was exercising her judicial authority and thus immune from prosecution. She criticized the federal government for undermining Wisconsin’s state sovereignty by pursuing charges against a state judge.
However, U.S. Magistrate Judge Nancy Joseph recommended against dismissing the charges, indicating that actions taken by judges in their official capacity may still lead to criminal prosecution if they violate the law. Dugan faces serious charges of obstruction of justice and concealing a person from arrest, potentially leading to up to six years in prison and a $350,000 fine if convicted.
Furthermore, Joseph stated that the questions surrounding Dugan’s judicial actions should be settled at trial. Footage has surfaced showing Dugan confronting ICE agents, which may play a critical role in the upcoming legal proceedings. Dugan’s attorney expressed disappointment with the recommendation and signaled an intention to appeal, emphasizing the importance of judicial independence throughout this process.
