Palestinian Activist Mahmoud Khalil Seeks Supreme Court Review of Deportation Case
Columbia University graduate Mahmoud Khalil has petitioned the US Supreme Court to overturn a ruling that permits the re-arrest and deportation of the Palestinian activist, who was arrested last year as the US moved to detain and deport non-citizens who engaged in pro-Palestinian activism on college campuses, as part of the Trump administration's broader policy.
According to the South China Morning Post, Mahmoud Khalil, a graduate of Columbia University, requested that the US Supreme Court review a decision that allowed the US President Donald Trump’s administration to re-arrest and deport the Palestinian activist on Monday.
Khalil's legal team asked the justices to hear his case subsequent to the Philadelphia-based 3rd US Circuit Court of Appeals ruling that federal immigration law prohibited a lower-court judge from issuing an order for his release from custody held by US Immigration and Customs Enforcement (ICE).
Khalil was among the most prominent foreign students to be arrested last year as the Trump administration pursued a campaign to detain and deport non-citizens who engaged in pro-Palestinian activism on college campuses.
Khalil's lawyers contend that the Supreme Court should clarify that immigration law does not preclude non-citizens from bringing cases asserting that their detention is intended to penalize them for speech protected under the US Constitution's First Amendment.
