Presgrove attended a multi-day party during the holiday weekend with friends before his lifeless body was discovered along U.S. Highway 81 on September 4, 2023. Items like his necklace, basketball shorts, and teeth were found near him, igniting further speculation about the circumstances of his demise. The lawsuit suggests he died due to actions from the party attendees rather than an accident involving a car.
The gathering allegedly involved underage drinking and was hosted by several defendants, with one being accused of purchasing alcohol despite being below the legal drinking age. As investigations continue, it has come to light that Presgrove had a blood alcohol content around twice the legal limit at the time of his death.
Following an ATV incident, where Presgrove reportedly rode while intoxicated, he ventured away from the party, later engaging in a confrontation with individuals present.
